Article 1 (purpose) These Terms and Conditions are Members (referring to those who have agreed to the RealmStep Service Terms and Conditions, hereinafter referred to as "Members") The purpose is to define the rights, obligations, and responsibilities of the company and its members in using RealmStep services provided by MustJ Inc. (hereinafter referred to as the "Service"). Article 2 (Effects and Changes of Terms and Conditions of Use) ①These Terms and Conditions take effect when the customer or the subject of personal location information who applied for the service agrees to these Terms and Conditions and registers as a user of the service according to the prescribed procedures set by the company. ②If a member clicks the "agree" button of this Terms and Conditions online, he/she shall be deemed to have read all the contents of these Terms and Conditions, fully understood them, and agreed to the application. ③The Company may revise these Terms and Conditions to the extent that they do not violate relevant laws, such as the Act on the Protection and Use of Location Information, the Content Industry Promotion Act, the Consumer Protection Act in Electronic Commerce, and the Act on the Regulation of the Terms and Conditions of the Basic Consumer Act. ④When the company revises the terms and conditions, it specifies the date and reason for the revision, and only notifies the current terms and conditions for a considerable period of time from 10 days before the application date. If the revision is unfavorable to the member, it will be posted on the service website for a considerable period of time from 30 days before the application date or sent to the member in electronic form (e-mail, SMS, etc.). ⑤If the company does not indicate its intention to reject the amendment seven days after the date of enforcement of the revised terms and conditions while notifying the members pursuant to the preceding paragraph, it shall be deemed to have approved the terms and conditions of use. If the member does not agree to the revised terms and conditions, the member may terminate the contract of use. Article 3 (Application of relevant laws and regulations) These terms and conditions shall be applied fairly in accordance with the principle of good faith, and matters not specified in these terms and conditions shall be subject to relevant laws and regulations. Article 4 (Contents of Service) The services provided by the company are as follows. Service Name: RealmStep Location-based social network services Location-based territorial occupation service Location facility information service Location-based advertising and additional services Article 5 (service fee) ①The services provided by the company are basically free of charge. However, in the case of a separate paid service, you must pay the fee specified in the service to use it. ②The company may charge the fee for using the service based on the method set by the electronic payment company contracted with the company or added to the bill set by the company. ③Cancellation and refund of payments made through the use of paid services are subject to related laws such as the company's payment terms and conditions. ④A refund request or a payer's request for a refund due to a member's theft of personal information and payment fraud may be rejected except as prescribed by law. ⑤Data communication fees incurred when using wireless services are separate and are subject to the policies of each mobile carrier. ⑥When registering a post through MMS, etc., the fee incurred is in accordance with the mobile carrier's policy. Article 6 (notification of service change, etc.) ①If the company changes or terminates the service, the company may notify the members of the change or termination of the service via email to their registered e-mail address, or SMS via mobile phone number. ②In the case of paragraph (1), when notifying an unspecified number of people, the members may be notified through other company notices such as the website. Article 7 (Restriction and suspension of service use) ①The company may restrict or suspend the use of services by members in the event of any of the following reasons. 1. Where a member intentionally or grossly interferes with the operation of the company's services 2. In case of inevitability due to inspection, repair, or construction of service facilities 3. When a telecommunications service provider suspends telecommunications services as prescribed by the Telecommunications Business Act 4. When there is a disruption in the use of services due to a national emergency, a failure of service facilities, or a congestion of service use 5. Where the company deems it inappropriate to continue providing services due to other serious reasons ②When the company restricts or suspends the use of the service pursuant to the provisions of the preceding paragraph, it shall inform the member of the reason, the period of restriction, etc. Article 8 (use or provision of personal location information) ①If the company intends to provide services using personal location information, it must obtain the consent of the personal location information subject after specifying it in advance in the terms of use. ②The rights of members and legal representatives and the method of exercise shall be based on the address of the user at the time of filing, and if there is no address, it shall be under the exclusive jurisdiction of the district court having jurisdiction over the residence. However, if the address or residence of the user is not clear at the time of filing, or if a foreign resident is present, it shall be filed with the competent court under the Civil Procedure Act. ③The company automatically records and preserves the use, provision, and fact-checking data of location information for rate settlement and civil complaint handling with third-party companies or customers, and keeps the data for six months. ④When the company provides personal location information to a third party designated by a member, it shall immediately notify the person who receives the personal location information, the date and time of provision, and the purpose of provision to the member each time through the relevant communication terminal device that collected the personal location information: Provided, That in cases falling under any of the following subparagraphs, it shall be notified to the communication terminal device or e-mail address designated by the member in advance. 1. Where the communication terminal device that collected personal location information does not have the function of receiving text, voice, or video 2. Where a member requests notification in advance by means of online posting, etc Article 9 (rights of personal location data subjects) ①A member may withdraw all or part of his/her consent to the provision of location-based services and the provision of personal location information to a third party at any time. In this case, the company shall destroy the collected personal location information, the use of location information, and the data confirming the fact of provision. ②Members may request the Company to temporarily suspend the collection, use, or provision of personal location information at any time, and the Company cannot refuse to do so and has the technical means to do so. ③A member may request the company to view or notify the following data, and may request correction if there is an error in the relevant data. In this case, the company cannot reject a member's request without justifiable grounds. 1. Data on collecting, using, and providing location information on the person 2. The reasons and details of the personal location information provided to a third party under the Act on the Protection and Use of Location Information or other laws ④Members may request the exercise of their rights under paragraphs 1 through 3 through the prescribed procedures of the company. Article 10 (rights of legal representatives) ① The company is a service that can be used by members over the age of 14 for the services provided, and members over the age of 14 obtain consent. The service cannot be used for members who have not agreed, and if they agree, they are judged to be over the age of 14, and all legal responsibility for false consent rests with the members who have agreed. Article 11 (designated by the person in charge of location information management) ①The company designates and operates a person who can take practical responsibility to properly manage and protect location information and handle complaints from personal location data subjects as a location information management officer. ②The information of the person in charge of location information management is as follows. 1. Contact: mustj2025@gmail.com Article 12 (damage compensation) ①If the company violates the provisions of Articles 15 to 26 of the Act on the Protection and Use of Location Information and causes damage to the member, the member may file a claim for damages against the company. In this case, the company cannot be exempted from liability if it fails to prove that it is not intentional or negligent. ②If a member violates the provisions of these terms and conditions and causes damage to the company, the company may claim damages from the member. In this case, the member cannot be exempted from liability if he fails to prove that he/she is not intentional or negligent. Article 13 (Exemption) ①The Company shall not be liable for any damages incurred to the Member if the Service cannot be provided in any of the following cases. 1. Where there is a natural disaster or a state of force majeure equivalent thereto 2. In the case of intentional obstruction of service by a third party who has entered into a service partnership contract with the company for the provision of services 3. Where there is a disability in the use of the service due to reasons attributable to the member 4. In cases where there is no intention or negligence of the company other than subparagraphs 1 through 3 ②The company does not guarantee the reliability, accuracy, etc. of information, data, facts, etc. posted in the services and services and shall not be liable for any damage to the members caused by such. Article 14 (Applicable to regulations) ①These terms and conditions are stipulated and implemented by laws and regulations of the Republic of Korea. ②Matters not stipulated in these Terms and Conditions shall be subject to relevant laws and regulations. Article 15 (Dispute Mediation and Others) ①The company may apply for a ruling to the Korea Communications Commission under Article 28 of the Act on the Protection and Use of Location Information if there is no consultation or consultation between the parties on disputes related to location information. ②The company or the customer may apply for mediation to the Personal Information Dispute Mediation Committee under Article 43 of the Personal Information Protection Act if there is no consultation between the parties or cannot negotiate a dispute related to the location information.
